{"id":3161,"date":"2023-01-25T16:41:07","date_gmt":"2023-01-25T16:41:07","guid":{"rendered":"https:\/\/r02fi4ct8m.wpdns.site\/amendments-to-the-bvi-bc-act-2022existing-struck-off-companies\/"},"modified":"2023-01-25T16:41:07","modified_gmt":"2023-01-25T16:41:07","slug":"amendments-to-the-bvi-bc-act-2022existing-struck-off-companies","status":"publish","type":"post","link":"https:\/\/www.gstaxconsultants.com\/el\/amendments-to-the-bvi-bc-act-2022existing-struck-off-companies\/","title":{"rendered":"AMENDMENTS TO THE BVI BC ACT 2022 EXISTING STRUCK-OFF COMPANIES"},"content":{"rendered":"<p>The BVI Business Companies Act 2004 was amended in 2022, to include changes to the process for restoring struck-off companies.<\/p>\n<p><!--more--><\/p>\n<p> The new applicable guidelines are the following:<\/p>\n<ul>\n<li>Companies that were struck off on <strong>January 1, 2023<\/strong> (\u201cexisting struck off companies\u201d) will only have until <strong>June 30, 2023<\/strong>, to be restored with the Registry.<\/li>\n<li>Restoration is not automatic, and payment of outstanding balances does not guarantee restoration.<\/li>\n<li>To restore a company, an application must be filed with the Company Registry, and the Registered Agent must confirm in writing that the company&#8217;s records have been audited. Registry fees will be charged to file this application.<\/li>\n<li>If a company is not restored within the given six (6) month period, <strong>January 1 to June 30, 2023,<\/strong> it will be deemed dissolved on the day following the end of such period <strong>(July 1, 2023).<\/strong> The registered agent will also be deemed to have resigned.<\/li>\n<li>To restore an existing struck-off company that dissolved on <strong>July 1, 202<\/strong>3, an application must be submitted to the BVI Courts.
